Pre-TUPE due diligence investigations
Most organisations only conduct TUPE due diligence once a transfer has been formally agreed. By that point, significant decisions have already been made, timelines are fixed, and the scope for changing course is limited.
Pre-TUPE due diligence is different. It happens before any firm, commitment is made, and its purpose is to give the acquiring organisation a clear, independent picture of what it is actually inheriting.
Our pre-TUPE investigations are comprehensive. We examine staffing structures and stability, pay scales and conditions across all employee groups, HR systems and documentation, employee relations history including any live or recent cases, training records and compliance, DBS and safeguarding compliance, union recognition and relationships, service contracts and their expiry dates, property and accommodation arrangements, and previous transfer history.
The result is a detailed report with risk assessments and strategic recommendations that enables leadership teams to make informed decisions about whether to proceed, what to budget for, what to prioritise in consultation, and where problems are likely to emerge during integration.
